The ACCC took Apple to court this morning over claims that its latest “iPad with WiFi + 4G” can connect to an Australian 4G network when it is incompatible with Telstra’s 4G network. The new iPad can connect to LTE networks on the 700MHz or 2100MHz bands, but Telstra’s 4G network runs on the 1800MHz band.
The competition regulator said that it would be seeking injunctions, pecuniary penalties, corrective advertising and refunds to consumers affected.
After the initial court hearings this morning, Apple said it was prepared to offer a refund to customers who believe they were misled by references to 4G. Apple made the claim that there were networks in Australia that were equivalent to overseas 4G networks.
A speed test conducted by sister site CNET shows the Telstra Next G network outperforming a 4G US network in a “real-world test”.
The court case resumes in Melbourne later this afternoon.
