since Apache doesn't execute any code in a static html file your example doesn't hold water.
unless the exploit is in the network interface card's driver, there is zero interaction with the system for your example to work with.
Apache reads the file into it's own ram stack, then pushes it through the network interface without involving the system at all.

a shtml file, yes, your system would work, but then, that isn't a static html file.
