You're absolutely right. Thank you for pointing that out.

Here is a link to Oracle's licensing documentation for 10g:

It clearly states that both the Enterprise Manager interface to the SQL Advisor and the DBMS_SQLTUNE PL/SQL package are subject to licensing the Tuning Pack.
