You should add repackaged apps. They are both bad for developers and users and it makes anything coming from a third party market suspicious.
I have to wonder how many of these problems will be reduced or will go away entirely if Google's purchase of Motorola Mobility Holdings goes through. Buying the hardware manufacturing arm and many of the associated patents may finally bring the scattered approach to developing products for Androids into sharp focus for Google.
Who knows, they may even give Apple a run for their money on more than the smartphone front.

Yes, indeed. Google's acquisition of Motorola has the potential to address a lot of these issues. If done right, 3, 5 and 8 could likely go away and significant dents for 2 and 4. I have noted a few additional observations on this acquisition in my personal blog at http://goo.gl/uJKmB
Nice workarounds. Just to add to your list of upsides, one positive outcome of open-sourcing is the recent innovation, "Aakash"....the world's cheapest tablet, powered by Android, to be delivered to the countryside! A interesting dichotomy of its open-ended nature.
