As I understand the law (and IANAL), if you research to see if you are violating a patent, you are much more liable if you end up violating a patent (even if your research does not find one), than if you ignore the research phase completely.

We, as an industry, need to pay attention to patent reform. There is a good chance Congress will just make things worse than they are already.
