Courts are issuing sanctions more frequently for inadequate search methodology, and recent opinions have highlighted the need for quality in search methodology. There are two reasons for improving the quality of the searches: reduce the amount of information that has to be reviewed; and reduce the cost of discovery. The downside for the requestor is that one may not get the right ESI. The downside for the respondent is that one might get sanctioned. Using a sophisticated keyword search can increase significantly the quality of the search while helping the practitioner avoid sanctions.
