The major thrust of insolvency reform across many jurisdictions over the last twenty years has been the development of legislation to both facilitate and promote business reorganizations. From Europe to Asia to the Pacific the notion of corporate rescue has found favour with policy makers, politicians and practitioners. Much of the development in this area no doubt stems from the analysis of Chapter 11 in the Bankruptcy Code 1978 (US) and the recommendation of the Cork Report in the UK as regards development of a more suitable regime in that country.
