Do the crime, do the time ... or not

by Too Old For IT In reply to No kidding..

Ok, so some 18 year old gets caught with his 17 year old girlfriend, and we lock him up for 5 years, label him a predator so he has to register and so the neighbors can harass him until he jumps offa the Brooklyn bridge. Fair enough.

So how come the same guy can sell crack cacine on the schoolyard, get 6 months for minor posession, and other than reporting to his parole officer, no one cares where he lives, hangs out at, yadda.

There are a whole lot of offences between capital murder and sex crimes that, when you've done your time, and done your parole, you're done.

Do we have to register, watch and harass these people off the Brooklyn Bridge as well?

Just askin ...

Absolutely not what I'm talking about..

by maecuff In reply to Do the crime, do the time ...

Of course that is different. And that situation is monumentally unfair. I'm talking about adults, who have sex or sexual contact with children. Not humans who are only seperated by a few years in age.

Again..

I specifically said PEDOPHILES. Not teenagers doing what teenagers do. Or the rest of us if we're lucky..

child porn is an Adult have sex with someone who has not yet reached puberty, completely different than even a 14 y/o with an 18 y/o [ legal here actually ]

here, even using 3d modelling applications to create an image that presents a character that appears to be a child in a sexual manner is illegal, as child porn. [ 3d studio max, maya, lightwave, softimage xsi, poser, cinema 4d, blender, wings are 3d modelling programs ]

yes a completely computer generated image depicting a mesh object that appears to be a child in a sexual manner is child porn in Canada.

Complicated web of laws

by JamesRL In reply to um....

Canada's laws are complicated - I don't know if the US laws are the same.

In Canada, the basic age of consent is 14. Frankly that scares the crap out of me cause I have kids approaching that age. For me 16 would be better but for now it is what it is.

But the age of consent means nothing in some cases. In the general case of an adult having sex with a child, it is legal once the child reaches the age of 14(and prostitution is not involved). If an adult conacts a minor (under 1 via the internet and they meet for sex, then its internet luring, a specific law that supercedes the age of consent. If the adult is in a position of authority (teacher, coach, priest), it is ilegal under an entirely different law.

Similarly prostitution, the sexual act around it is legal in Canada. Whats not legal is communicating for the purposes of prostituion. And since some form of communication must take place....unless you have two psychics.

And as Jacqui points out, while it may be legal to have sex with someone 14 and older, any pictures or even graphic descriptions of sex with one person under 18 is illegal(child porn).

To me the answer is obvious - raise the age of consent.

and here I thought

by Too Old For IT In reply to um....

pedophilia was an Adult have sex with someone who was under the age of 18 (or 17, or 16 or 15 or 14 or 13 or 12 .. depending on which side of the two-lane gravel road you are on)

Child pornography is another story, wherein what is completely legal in say the Netherlands, is going to jail illegal here in the USA (Gawd, we are prudes sometimes!!)

Not nearly as prudish as you Cannucks and the 3d modeling program. How are they reagarding those over 18 who look like they are underage?

Another view

by Too Old For IT In reply to um....

"When U.S. Supreme Court Justice Ruth Bader Ginsburg was an attorney for the ACLU, she co-authored a report recommending that the age of consent for sexual acts be lowered to 12 years of age," I guess under the theory that this is when puberyt starts/happens/finishes and if it was lowered thereto, it would reduce the amount of police resources devoted to chasing pedophiles.

(And maybe they could get after the backlog of armed robberies, actual rapes, murders and so forth that never get resolved. Yeah, right.)

See, this is one thing that chafes my wallet: Police would rather spend 24/7/365 into chasing down some guy watching a movie of a 10-something russian model dressed up like a tween-ager in a rounchy movie (or troll an internet chat room posing as a 13 year old girl) rather than get out there and go mano-et-mano with the vast number of Young Urban Males pistol-whipping store owners, robbing gas stations, knocking over banks, selling crack cocaine on the street corner ... do I need to go on?

wait..wait..wait..

Did I misread this? I reread it a few times, but it still seems to me that you are saying that we can be prudes in the US because child porn is illegal?

Mae, I don't think so

I don't think you misread his remarks. I am waiting to see how he responds to your question, though before saying anything. :-||

Maybe prudes was the wrong word (it was late)

by Too Old For IT In reply to um....

... when we (the US) try and apply our crazy-quilt of laws, rules, regulations and interpretations thereof on other countries where the law for the entire country is clear on the topic.

I'll take nominations for a better one-word description, since I missed.

(Better?)
