    What do you folks think? Where will it go from here? Are we headed down a long, slippery slope to industry and government Internet content control?

      it would seem that this is a challenge to copyright material, and if it can/should be controlled.

      Food for thought for the morons in the music industry. I USED to buy a lot of CD’s. I would use Napster to check out music. What I liked, I went out and bought, what I didn’t, I deleted. When punks like Lars started suing their fans is when I stopped buying ANY Metalica products, and stopped buying CD’s for several years. I now buy some, but nothing new until I have a chance to check it out on one of the on-line music sites.

      It would be interesting to see how different things would be if they did a few simple things.

      One, quit wasting time and money coming up with new anti-copy software that is quickly defeated (sometimes with a marker…)

      and two, cut the cost to a REASONABLE cost. It is unreasonable and unethical for the price of a CD to be where it is. If the price wasn’t so unreasonable, most people that do copy music wouldn’t because the savings would not be as great as they are now and it wouldn’t be worth the time.

        of buying LP’s and CD’s that contain only 1 or 2 good tunes for a premium price, I’m with you in the ‘I want to hear the whole thing first’ department.

        I did the same with Napster, then with LimeWire. I don’t anymore because of all the potential legal issues. Which also means I don’t buy as much music as I used to. I don’t have the time to sit in the music store and listen to the CD’s I’m interested in while doing nothing else. At least with the sharing options I could get some work done while listening.

          It is bad enough the price you are charge for a CD. When you take away most of the physical expenses but don’t lower the price of the product, it is a suckers bet.

          Considering inflation, I don’t regard it as an unreasonable expense. I guess it all depends on what you want to spend your money on and what a tune is worth to you. Where do you suggest I get songs cheaper, legally?

          of a 45 that was sold in a traditional store vs a single song downloaded from a web site, yes, that price should be less than buying the whole CD. That is before you even take away shipping/manufacture/warehousing/storefront expenses.

          but the quality of the purchase. 128 or even 192 kbs is not CD quality, especially when sent in a lossy, compressed format. Its like unwrapping a Godiva box and getting Hershy’s Kisses inside, still okay, but not what you paid for.

          YOu mean like cover art that has to be purchased from an aritist (expensive), the booklet design, four stage printing, copy and editing, the CD run is reasonable but then there is packaging, labelling, distribution etc. That’s before it hits stores.

          This is one of the reasons that the big four bought out a lot of radio stations, they own the retail outlets etc. Free floorspace, no broadcast payola. They also own packaging companies of course so they don’t have ot pay exorbitant costs for CD publishing.

          It costs money to publish, print and package a finished CD. It costs more money to retail it.

          For those who think they are paying artists by buying CD’s as opposed to downloading them, don’t bother. the artist gets such a small chunk of that change it’s laughable (unless you are the artist, in which case it is not funny at all).

          Instead, buy a concert ticket and when yuo get to the show, buy food and drink, buy a tshirt and a program, THEN the artist gets paid.

          We have a couple of major outlets here that offer downloads but it is hard for them to be lawful about it. The RIAA is constantly on at them to provide DRM protected music, but DRM protection counters Canadian copyright laws, which state you must be able to make a copy of and store any copyrighted materials, including books, music, TV, Movies etc. This is the first step to workign around the label bandits that try to rape consumers and screw artists in the same process (no the artists still haven’t seen any money from it yet, they’d rather you used BitTorrent to get their music and them buy a concert ticket instead). the other problem is that the ISP’s cannot legally provide user info to the labels, andno supreme court judges will overrule that as of yet, despite pressure form the Us to adhere to THEIR laws instead.

          As for paid downloads, they do make sense when you want one song off a disk (usually they only include one song woth buying these days anyway). This is of course, if you are in america, are paranoid about getting nailed for downloading one song and want to buy it instead.

          As for buying whole albums, its a waste. Not only is teh music ocmpressed, even teh “high quality” downloads sound like shite on a good system.

          a while back, a friend in Germany sent me the prerelease tracks for Judas Priests Nostradamus CD. I played it non stop and enjoyed it ALL (concept album you can’t pick tracks out it just doesn’t work that way). BUT…when it was released in North America a few weeks later, I stopped at Best Buy before even gettign to work so I could buy a retail version. I support Priest, they don’t get paid for radio rotation and rely on concerts, merchandise sales and CD sales to keep going. I also got, 23 tracks (9 intros and 14 main songs) of the highest quality music for $15.99 (intriductory sale price). It was money well spent, for me anyway.

          But what are you gonna do with most North American music? One track is great, one track is okay and the rest is crap.

          YOu are better off just downloading it as a torrent file, as the quality will be similar to the paid download anyway and not labelled with a restrictive DRM licence.

          So unless a band is ready to put out a full CD of tracks I want to hear, unless they are NOT part of the US record industry and don’t have huge corporate giants illegally protecting music the artist doesn’t get paid for, I have no interest in buying any music these days.

          I don’t bother with LimeWire, Kazaa (if that’s still around) etc. I use torrents, you can get a full FLAC file (fully lossless Audio codec) or similar high bitrate rip in full album format, or sleect the songs you want from it, instead of taking chances with single song downloads from crappy P2P services with viruses and protected music, excessively compressed 128bit tracks etc.

          Utorrent forever! 😀

          It seems that you are not allowed ot back up yoru purchases in the USA, but you’d have to take up that issue with the RIAA. YOu may have to get in the back of a very long line, definitely pack a few weeks meals.

          When I play back 128 bit mp3s over my stereo, the crappy sound makes my teeth grit… shrill highs, truncated bass, flat mids… like beer witha cig butt in it…
          MP3 was optimized for low end consumer products, not audiophile, or even close to audiophile gear.

          I actually worked for the fist Paradigm dealer in Western Canada in er, ahem….1986? OUCH!

          I rep MUCH higher end speakers now, real audio by one of the only remaining US companies that actually builds its product in America. Just about everything, once made in the USA, is now made in China or Mexico (Polk, sputter, sputter, plooey!) Bose has also gone to shite over the last 10 years, every since people started to realize that the little cubes are misrepresented, cannot provide the frequencies advertised and other manufacturers are making speakers than CAN at a lower cost, but Bose had strong marketing , so they sold well. (blah blah blah, what was I on about? Paradigm, right.

          The OLD 9SE’s were an amazing sounding speaker, they had that Canadian tone that was a mix between the detailed European sound and bassy US sound, lots of punch for rock music but bit of a honky upper-midrange for classical reeds and woodwinds tough.

          The Paradigm 11 was a great model too, much better mid than the 9’s for Classical but less bottom end punch for rock music. Over the last 5-8 years they have slid a fair bit though. Since they have changed their distribution model, as many foolish speaker manufacturer’s do, into a high distribution, low margin market. It reduces quality, reduces the resale value and overall value for money. For a dealer they are nice because they are easy to sell, you don’t actually need trained staff because they market the name well and face it people do actally buy a name when they can’t discern good from bad by themselves.

          The manufacturer I work with now, which I won’t mention online as there is only one distributor (me/us) are absolutely astounding. They make their own product in the US, utilizing their own proprietary capacitors, transducers, cone materials etc. They actually used to design and build many other high end speakers for other companies like JBL, Cerwin Vega etc.

          I used to own Paradim 9’s which I gudgingly traded for some Altec Lansing ‘furniture’, it was too good of a deal to pass up. I got rid of my Mission 770’s, no matter how good they are I just grew tired of that typical British speaker sound which was so popular here in the late 80’s early 90’s. It is great for analogue music (LP’s) but lacks for digital (CD’s or DAT’s).

          What do you drive your Paradigms with?

          I cllect vintage audio stuff when I can, right now I am driving some Scandinavian beauties with a Harman Kardon CLASSIC, the PM665.

          A clean 100WPC in to 8 ohms, but over 380 WPC into 4 ohms due to high current capability, a WHOPPING 60 Amps!!!! WOO HOOOO!!!! An amp you can weld with, now THAT’s audio. Got it for a song too because everyone is stuck on bells and whistles still, especially with 5.1 and 7.1 HT systems in he mix.

          I don’t buy a new book without paging through it a bit, and I don’t buy music unless I know what I’m getting either.

          I hope the artists themselves rebel against the industry.

          Heck, if I were an artist, I’d release a video direct to YouTube, promo the HELL out of it, and give a discount on ticket sales to my concert for anyone who mentioned the video.

          These idiots are missing a marketing GOLDMINE!

If Chris Crocker and Tay Zonday can get famous (whom of which most would agree are completely ridiculous), then why not new young aspiring talent. After all, American Idol is a bit narrow as far as genre is concerned. Weezer has been signed with Geffen records since 1994 I think, So what is it that they want to be? Anyway, if I want to watch Jon Stewart pretend to be funny without getting my personal information divulged to Viacom, I think I have that right.

          I’m one of the those people that think any skill or activity can be refined the the level of an art.

          One can punch another person or fight through brute force but contrast that with a martial artist who uses refined technique, a calm mind and instinctive imagination. At some level, they simply stop thinking in terms of fighting and just let the creativity solve the threat; this is actually the ultimate goal of many arts.

          My opinion is that anything can be refined to the point where it is an art. Not by everyone; most of us will simply cook our food and eat while other’s will create true art on a plate.

          Some argue that art is not art if it is practical. I think that idea is bunk but some feel that way.

          Painting, sculpting and the other “classics” are obvious. What practical use is a five thousand dollar hand made picture hanging on the wall – none, it’s art and look at the brush strokes used.

          Heck, using a pushbroom could be refined to an art based on the perfect technique to maximize sweep while minimizing the dust cloud from it.

          Really though, the “what is art” topic would be a huge discussion with no possible common conclusion. There is a whole area of philosophy devoted to figuring out what art is.

          Looking at the last few posts (boxi/sam), a more generic usage is for someone that is highly skilled in their craft. Admittedly, most people that make up pop music are NOT highly skilled in their craft.

          To question further, sure, there references to the art of communication, but do you ever refer to that person as an artist?

          Then there is the “liberal arts” degree, that allows you to ask “would you like fries with that” in three languages…..

          Any CREATIVE talent may be art (programming included!). I’m probably the biggest NASCAR fan here. Drivers are talented, but they aren’t creative nor are they artists.

          A band i manage in Europe is JUSt finishing a festival tour with WhiteSnake, Motorhead, Judas Priest, Alice Cooper, DefLeppard, Kiss and many others. WHAT A LINEUP!!!!!!!!!

          They are also playing the Magic Circle festival in Bad Arlosen, Germany this weekend (was up all night doing releases gawd am I waxed!). Lineup includes, Manowar (healine) Whitesnake, DefLeppard, Alice Cooper, TedNugent, WASP, and about 30 more.

          UNBELIEVABLE!!!

          Perhaps you can see why I am always going on abotu teh crappy music scene we have here, in comparrison it is the lamest scene on teh planet. Even Iran and Israel get better tours that we do in North America! We are a joke to the music world, REALLY!

          Why don’t we get outdoor fesitval shows like THAT out here?

          because the record companies don’t make any money selling it ‘kin losers, what about the people?

          It’s pretty sad when fans no longer dominate the music scene, REALLY sad in fact.

        I don’t even download music anymore. I buy maybe 2 cd’s a year (down from 20-40) If I download it, its from Archive.org, or such where the copywright has clearly expired and the product exists in the public domain.

      I think the ruling was partially correct. If someone is “damaging” you, you have every right to calculate how much you’ve been damaged, so that you can try to recover from the “damager” (in this case, the person(s) who posted the material). To do this you need to know how many unique people viewed the videos you hold copyright to.

      However, I do not believe it is your right to know how many people viewed videos that you do [b]not[/b] hold the copyright to. This information is of no legitimate use to you.

      Though the consequences may be vast, the decision is only half-vast.

      Here we go again.

      It seems, as always, that the US corporations and US government work in lock-step with each other. Once again, we see an issue where the US Constituion is ignored and used to protect corporations instead of the American citizens it was supposedly set to protect.

      Once this slides, it will soon appear in Canada too, under pressure by US companies to watch Canadians.

      It’s the same as file sharing laws, in Canada even they are starting to be questioned now as the US clamps down on its offenders, which includes Canada too now it seems, if we have to live by your laws, where MY cheap gas, smokes and food? Why can’t I buy beer at 7-11 or Safeway? (ok, well that’s a Canadian issue but if we have to follow suit, we should reap the benefits of these corporations and laws too).

      Yeah, your gas is CHEAP, actually one of the lowest prices in the world, and yet most of your gas is imported from other countries.

      In Canada, no matter how many times the RIAA and MPAA have tried to nail down file sharing, Canadian Supreme court judges keep overruling the request for Canadian ISP’s to hand over customer information. Our government protects our rights and not the companies that try to change them. However they are bending and contorting our rights any way they can to appease the US companies while still trying to toe the line for Canadian citizens. I am sure that eventually it will be a free for all and anyone’s info is no longer private at all.

      This is just another step in the same old direction, in order for Canadian ISP’s to release customer info, they would have to breach our provacy rights. At the absolute most ,YouTube can be provided with an IP address, if they battle with local ISP’s, but they can’t get the name or other info attached to it, and thus cannot prosecute an offender.

      I suppose the pressure will be on for another 5-10 years to remove those rights from Canadians too, thanks to the unConstitutional US government that was founded on freedoms and personal liberties.

      Please just leave our overly restrictive and socialist/fascist laws alone. If the US is really deemed to be the free nation, we don’t want such freedoms.

      Elect a new rep. (not republican, but representative) in the White House that wants to keep your laws in your own ‘kin country for a change.

          It used to be only the govrenment liquor stores, then bars started opening cold beer stores for buying off-sales, then Cold Beer stores were everywhere, and now they are allowed to sell hard liquor.

          The nice thing about a private liquor store is that I can buy cold beer on a Sunday morning on the way to the track, they are also open late and they are everywhere now.

          It’s not as bad as it used to be, and at least our beer actually has a trace of alcohol in it.

          They can sell it in 7-11 in the US because Jolt Cola or Perrier water is more likely to give you a buzz.

          the only drag is that is costs $28 for a 12 pack of cold beer, but then again, we genrally get paid more so I guess they feel they can charge us more too.

          In Ontario, we have a “Beer Store” which is owned by the three big breweries and a gov’t owned Liquor Store.

          In Quebec they have a gov’t Liquor Store and beer is available at almost every corner store.

          In the Beer Store you can get three hundred kinds of beer. And its cheaper than in Quebec. But the number of outlets is smaller and the hours aren’t as late. We don’t have off sales. And the exotic foreign beers are available at the Liquor Store.

          sure they do, SURE they do!! It is always American citizens best interests that they care about.

          As for worryign about my own ‘kin country for a change, that would be easy but you seem to forget that anything YOUR country does has effect on MY country (if Canada is assumed as my country these days).

          When YOUR country can keep YOUR politics inside YOUR borders, then YOU have a right to tell people to mind their own business.

          When YOUR country takes YOUR agendas to the WORLD stage and places the rest of the allied nations in jeopardy while spitting at them through gritted teeth, guess what, YOUR problem is now MY problem and I’ll tell you straight up that I don’t ‘kin like YOUR business in MY face.

      It’s silly.

      If YouTube can be sued, then every VCR and DVD recorder should be suable too.

      YouTube is a medium on which videos are stored, just like a VCR tape or DVD. Just the storage is on a server, rather than on a shelf.

      Personally, I’d like to sue Viacom for having such crappy programming.

      WHERE IS THE MAN SHOW AND CRANK YANKERS?!?!?!

      They were too cheap to pay talent real money.
