Email Server Probing

IHAC with an email package that does some probing of the source end of each email from new domains – used to reject SPAM etc.

Does anyone have any info on the legalities of this type of activity? Specifically, in protecting a network, what is ‘allowed’ in the way of remote server probing etc?
