Win ME locking up during operation

I have a new ACER TM350TE that came with Windows ME. It will lock up tight(power down to restart)at the most inopportune times; like during SCANDISK or DEFRAG or downloading large files. I just downloaded and installed MS latest patches for ME and it seems to be better. Do I have a defective machine or a defective O/S?
