I’ve seen this situation occur time and time again, and it’s usually a sign that the company is looking to get rid of the consultant or contractor and replace him/her with a permanent employee who needs serious training to be brought up to speed. Now the question boils down to this…does the consultant/contractor have a right to refuse to train the employee of the company that his/her services are being offered to? From a logical perspective, why would anyone be willing to sign their own death warrant and be made redundant and obsolete. I know that consultants are meant to be temporary staff and such, but if they can prolong their contract, why would they do anything to jeopardize their own self interests? If it isn’t specifically stated in the contract or statement of work that training will be provided to employees by the consultant, can the consultant turn this into a legal matter by claiming breach of contract? I’d like to hear your thoughts from the point of view of those of you who are employers, employees, and consultants.
