Only profesionals do not have to be paid Overtime. Your employeers also need to treat you like a professional giving you a lot of leeway to do your job with respect to hours and approach. Generally they should require a 4 year degree. Making a case with the Feds for people in IT may not be easy in most cases. One would have to document that you were treated like an hourly employee, for example written up for coming in late or constantly told not to use judgement. Also if a 4 year degree is not required, it will be a much easier to say the job should be hourly.

Help desk, desktop, operators, device installers most likely are not considered professonal.
