Win98 new PC only, but want to upgrade

I know I shoudnt be asking this because it’s probably illegal.

I have a Win98 “For new PC only” but I want to upgrade my Win 95 without reformatting the hard disk.

I tried SYS c:
to copy the Win98 operating system to my Hard Disk, this workedbut the SETUP install still says “Use a Windows 98 Upgrade CD”
