most[if not all]modems come with a diagnostic utility [some are loaded when you load the drivers, some you have to run from the floppy [or CD]. open the control panel, click on phone & modem properties, click on the modems tab, highlight your modem,next the click on properties in the lower right corner. on the modem properties dialog box, the center tab should say diagnostics [if the diagnostic utility was loaded with drivers]. Down on the lower right corner, you should see query modem. Click the radio button. A dialog box should come up saying "querying modem, please wait". The diagnostic utility will send a query to the modem for loopback testing. In the middle pane of the modem properties box, you should see a list of commands sent from the loopback of the modem. This indicates your modem will accept a query. If you don't get a response from the modem, check the comm port assignments for the modem. It's possible that the modem is trying to communicate on a port that's already being used.

answer helped leaad me ato the correct resolution which was a hardware problem thanks
