We still haven’t implemented the policy yet. Plans were scaled back a bit. Now we’re planning to phase it in – starting with the peons and working our way up. Will also tell everyone to save what they deem as important either as a file or to hardcopy, so it’s not like we’re mass-destroying e-mail (or so it appears).
I once again aired my concerns with my boss – he said (and apparently he’s just echoing what he was told) that they can’t subpoena what you don’t have. I asked him if the big boss was nuts – and he’s said he doesn’t disagree with me – that this is coming from up top. He said something to the effect that if Enron didn’t destroy what they did – they’d be in even deepter trouble. Great – more red flags, eh?
I asked if we were going to have a written policy for e-mail retention… he didn’t think so, but would bring it up to his boss – but doubts they’ll want one.
Not gonna look good if we ever did get subpoenaed and when I have to testify in court “well no – we don’t have a written e-mail retention policy… just following orders”.
Ugh.
