Netflix vs Blockbuster

What do you think of this? Specifically, should a business practice qualify as something that one can patent?

These lawsuits are, in my humble opinion, out of control. Technology yes, practices no.

Netflix can't have it both ways. Its model is based on a monthly fee, whereas Blockbuster's is base on a per rental price. Hard to see where late fees and the policies around them is patentable.
