What is the Hourly Limit for Overtime?

Several of my friends and I have the same question. What is the hourly limit for overtime? The rate used to be 27.26, but the minimum wage has increased and the rate should be 6.5 times that but I can not find any information about this. Anyone know where I can locate this information?

I read a article a couple of weeks ago,but can't remember where, but it stated that over time has to be paid on any wage under 7 times the min. wage ($5.15)or $36.05 per hour

I am not aware of an hourly limit for overtime. I believe overtime pay is determined by whether you are an exempt or non exempt employee. Definitions of this and more can be found on the DOL web site http://www.dol.gov/dol/public/regs/main.htm

There is NO limit on the hourly rate that is subject to overtime pay. It depends on your title, job description, duties, and payroll type (hourly vs. salary) - as defined by the US Department of Labor. Note that just because someone is salaried, it does NOT mean that they are exempt from overtime. Go o the Dept. of Labor website and check into the details there...

I am not aware of any limit except in government posititions. Commercial overtime is normally set for non-exempt employees. Most of the IT staff I have worked with are in the exempt category (We don't get overtime or are paid at a lower rate). You may want to look in National Labor Relation Board.

The reason that many IT folks are not entitled to OT is because they fall under the category of professionals this is what eliminates the legal aspects of OT. Now some companies do provide it but they are not required to for Professionals.
