Bad Attitude

I have an employee, who has the most appalling attitude I have ever seen. No one can speak to this person without him flying off the handle. He is a disruption to the rest of the team. HR and my IT Exec, want to treathim with kit gloves, which I believe gives him the green light to continue with this behaviour. His performance is suffering, although I am not ‘allowed’ to formal performance council him. Any suugestions on what I am be able to do with this person – legally and within the rules and regukations of HR.
