My company is contracting to have an e-commerce application developed and hosted by a third party. I want to add specific language to the contract to ensure the production strength of both their hosting infrastructure and the application itself. It seems that holding them accountable for end-to-end response time is not feasible given that they are dependent on many networks and components outside of their control. What is fair to contract for in this type of situation, to ensure my goals? Thanks for any and all advice!!!
