Kazaa case study ..... Pllzz help

The Kazaa software allows you to search and download content that is shared by premium content providers or by other Kazaa users; create your own files and distribute them using Kazaa.
Note that it is possible for a user when sharing/distributing a folder, to inadvertently make subfolders also available to all peers in the Kazaa network.

The privacy statement on Kazaa?s web site states that third party sites may link to and from Kazaa sites and thus may collect information about a user if a user opts to visit one of these sites. The following text appears in Kazaa?s privacy statement:
?Information about you (such as the version of Kazaa being used or your country) may be placed in the URL on kazaa.com, allowing customized features for the user. This will be visible to subsequent websites if you link off a Kazaa page. However, even if the third party is affiliated with us, we have no control over these linked sites, each of which has separate privacy and data collection practices independent of us. Data collected by our co-brand partners or third party web sites (even if offered on or through our site) is not received by us. As such, we are not responsible for, or have any control over, the privacy policies of those third party websites, and encourage all users to read the privacy policies of each and every website visited when linking directly from kazaa.com. These linked sites are only for your convenience and you therefore access them at your own risk.?

Application of theories of the issues in Kaaza.com

Consequence-based ethical theories (utilitarian)
According to consequence based ethical theory, Jeremy Bentham argued the principle of social utility and how consequence of social utility be measured that is measuring the social utility in the form of happiness. He focuses on the greatest good to the greatest number of people. For example;

?An act X or policy Y is morally permissible if the consequences that result from (X or Y ) gives the greatest amount of happiness to the greatest number of persons affected by the act or the policy?.

Therefore, the majority of Kaaza.com users are happy so the privacy of information is not breached. This theory focuses on the majority happiness thus the accessibility of information i.e. data exchange and security issues are not important factors according to utilitarians as Kaaza users is morally permissible.

Some critics of utilitarian theory argued that morality can never be grounded in the context of happiness or the consequences. Thus how Kaaza.com users are morally justified that it gives the greatest happiness though there will be security issues and violation of one?s privacy. There maybe some Kaaza.com users who are concerned about their privacy as any Kaaza member can access any documents/files from their personal computer and Kaaza is not liable for such data exchange or security of any personal data. Thus minority justice and concerns are ignored by Utilitarians.

Duty-based Ethical Theory

This theory focuses on the roles of duty and the respects of persons. Kant argued that morality can ultimately be grounded in roles of duty or obligations. This ethical theory is action based non-consequentialist theory. It does not focus on the happiness of the people. Deon in Greek means duty or obligation and refers to the ethical theory that places duty and obedience in the centre of ethical decisions.

Using Kaaza.com violates the privacy for its users and there is also limited security over personal data. According to deontological theory one has the role of duty not to interfere anyone?s privacy. Thus data exchange information or having access to ones physical space is violated by the use of Kaaza.com. There should be a balance between the breach of privacy and the security of data.

Ross another critic of this theory argues that Kant did not provide solution for two conflicting duties. Eg we have duty to ?keep the promise? and ?not to lie?. In this case we have duty not to invade one?s privacy and as well as maintain the security when using Kaaza.com to download information that are in our interests. If the user has the permission to download from another user?s personal computer, then what?s the guaranty that he/she will not download the materials that was not permitted to them?

well this neither homework nor copy n paste. its my exam on 14feb i want more ideas that all.i thought someone can eloborate the thoughts s that i can understand the topic according to my perceptions.
