Modem Problem on Notebook

I have a Laptop which was initially installed with Windows 98SE; this began stalling, so I wiped the hard disk and installed Windows XP. Everything has loaded OK and a new driver was installed off Internet for the internal modem. Doing a modem diagnostics check reveals all is OK and there are no configeration interupt problmes. However, when I plug the modem into my phone system it locks up the line and then comes up with a message of "No dial tone". The line works fine when I unplug it and the lead being used on the dial-up modem works OK on a phone.
I have emailed the supplier of the modem and driver (SMLINK.COM) but have received no response.

What make/model of modem is it? Is it internal or external? Is is compatible with XP?

As stated, the Modem is an Internal one and I do not know its maker. When Windows 98 was working I looked at the system and downloaded the XP driver for it. The driver identifies itself as a SMLINK 56k device.
Any help would be appreciated please
