By naveenusa ·
Wondered any Non-American has started a company in the USA, when in H1B Visa or without being a Citizen or holder of green card. I want to know the possibilities, advantages and disadvantages.
Any body done this or know of somebody who hasdone this.

US Partners & Local Gov

by Al Macintyre In reply to Non-American Starting com ...

Companies are incorporated in individual states of the USA & each state has different regulations. Many companies incorporate in Delaware because they have among the most lax rules.

Most US states require that a majority of the company be owned by US citizens, and time of formation, but I do not know if that is a universal requirement. I also know that many companies that were formerly US corporations have been bought out by foreign interests & this has been approved by US judicial authorities that monitor such matters.

Thus, I think it might be an uphill battle for someone starting at the bottom to form a US company without US citizenship or US partners, I do not believe such an entitity is impossible. You will need to research incorporation law in multiple states.
