Contract Cancellation - Email filtering services

Hello All,

Some time ago my predecessor signed a three year contract with a large (and well known) company for email filtering services (anti-spam, anti-virus, image control). We had considerable problems with them and after a few months stopped using their services altogether (routed our emails direct to our server and filtered them ourselves with Sophos products). It was never possible to prove that the service was inadequate (ironically this was due to internal communication problems, which was more or less why we found the service unusable in the first place).

I asked them to let us out of the contract (we are a charity with very limited funds and struggling somewhat) but they refused my many (polite) requests.

Can anyone tell me if the fact that we haven't used the service for 18 months or more makes the contract such an inaccurate description of our relationship with the organisation that it is no longer valid? Does this work with IT contracts?

If it is not possible to win on this basis, I will simply have to refuse to pay the invoice this year and let them do what they will.

Does anyone have any comments or advice on this?
