If the modem works there's no reason to worry about which port is in use. As long as there's no conflicts no big deal What's more important than the port number is IRQ and I/O addresses. Port 1 & 3 use the same IRQ (4 by default) but different addresses 3f8, 3e8. Since you probably have a plug-n-pray modem it gets resources assigned as opposed to being able to set it up. When you change the port settings in device manager the actual device isn't being changed.

If there's a problem using themodem and the other com port isn't in use disable it in the system bios. If you're not experienced don't get all happy with making changes to the bios, becuase the wrong settings will cause the system not to boot. For most computers to access the bios hit the delete key as prompted when the computer first boots. The ports are usually listed in the intergrated peripherals section. Use arrow keys to move around, then enter key to make selections. Select com 1 which may be listed as a serial port and use page-up/page-down keys to change to disable. Escape from that page hit F10 to save and reboot.

RCOM has the answer correct, or if you MUST use port 3 go to www.GRC.com find "Unplug & Pray", follow his advice and get rid of the Plug & Play function altogether, then set up the modem the way you wish. Which is what Steve @ GRC wrote the program for along w/ the many other serious security problems associated w/ the MS "Plug & Pray" system according to him.
